Indemnification

Modifying your vehicle with aftermarket products or parts can be dangerous. Race Protocol understands that vehicle modification is both a passion and a hobby for many, and we strive to offer the best aftermarket products. By purchasing products from Race Protocol, you agree to indemnify, defend, and hold harmless Race Protocol, its officers, directors, employees, agents, licensors, and suppliers from any and all claims, losses, expenses, damages, and costs, including reasonable attorney’s fees, arising from or related to your use of this website or the purchase and use of any aftermarket products or parts.

You acknowledge that you purchase, install, and use aftermarket products at your own risk. No warranties or representations are made that aftermarket products will prevent injury or death, or protect the user from injury or death. The user expressly assumes all risks associated with the installation or use of aftermarket products. It is the responsibility of the purchaser or user to properly install, use, and maintain both factory and aftermarket products on their vehicle. Race Protocol strongly recommends that you do not remove factory safety equipment from any vehicle. Removing or modifying factory safety features is done at the purchaser’s or user’s own risk. Race Protocol advises that all customers follow the manufacturer’s warnings and recommendations.

 

Limitation of Liability Disclaimer

Except where otherwise prohibited by law, you expressly agree and understand that Race Protocol assumes no responsibility or liability for damage, injury, fatality, or legal penalties resulting from the proper or improper use of our products.

Please note that many of our products may not be legal for street or off-road use in certain areas. If you have concerns about the legality or suitability of a product, we recommend that you consult local regulations or contact local authorities, such as law enforcement, the DMV, or the State Emissions Board, to confirm whether the product can be used or purchased in your area before placing an order. It is your responsibility to do this research.

You further understand that Race Protocol is not liable for any issues arising from the use of our products by others whom you loan, give, or sell them to. By purchasing from Race Protocol, you acknowledge and accept this disclaimer and the policies outlined herein. Additionally, operating products of this nature can be inherently dangerous for individuals of any age.

 

Off-Road / Race Use Products

Off-road and race-only products (“the Product”) are intended for use in sanctioned, organized racing events, whether amateur or professional, on closed-course or open-course tracks. These products are not intended for use on public highways or for recreational off-road use, except for competition purposes. By purchasing or using this Product, you agree to use the vehicle only for competitive purposes as outlined herein, and you confirm that the purchase, installation, and use of this Product comply with all applicable federal, state, and local laws, rules, and regulations.

By accepting this disclaimer, you indemnify and hold harmless Race Protocol, its officers, employees, agents, distributors, and dealers from any damages, penalties, fines, expenses, or other costs that may arise from the use of this Product, and you acknowledge the following:

  • Use of this Product for any purpose other than competition may violate federal, state, or local laws, including environmental or motor vehicle regulations.
  • The use of this Product may void the vehicle’s manufacturer warranty or other warranties.
  • Use of this Product may make the vehicle unsafe or unfit for normal use, potentially causing personal injury, property damage, or death.
  • Improper installation, incorrect use, or failure to use this Product in conjunction with other compatible components could lead to personal injury, property damage, or death.

THESE PRODUCTS ARE FOR COMPETITION USE ONLY. ANY OTHER USE IS IN VIOLATION OF FEDERAL LAW. DO NOT PURCHASE OR INSTALL THESE PRODUCTS IF YOU INTEND TO USE IT ON HIGHWAYS OR FOR NON-COMPETITION OFF-ROAD PURPOSES.

 

Pricing or Typographical Errors

At Race Protocol, we do our best to provide accurate pricing and shipping information. However, pricing and typographical errors do occasionally occur. In some instances, we may not be able to confirm the correct pricing for a product or shipping until after an order is placed. If a pricing or typographical error is found, Race Protocol reserves the right to cancel or refuse the order at any time, without prior notice.

In most cases of pricing or typographical errors, we will reach out to you for further instructions or cancel the order and notify you via email or phone. Please note that discrepancies in shipping costs may arise on any order, regardless of size. If this happens, we may contact you to offer revised shipping options.

Order Acceptance

Race Protocol reserves the right to cancel or refuse any order at any time, without notice. Situations that may lead to an order cancellation include limitations on product availability, inaccuracies, errors in product or pricing information, or issues identified by our Credit and Fraud Prevention Department. In some cases, we may contact you to verify additional information or request a secured payment method before processing your order. If your order is canceled or additional information is required, Race Protocol may contact you via phone and/or email. Please ensure that the contact information provided with your order is valid, as invalid or fictitious contact details may result in order cancellation.

For first-time orders with Race Protocol, we require that your order be shipped to the billing address associated with your credit card. Providing mismatched addresses or using an address different from what is listed on your card or bank statement may cause delays during the order review process.

In most cases, your credit card will be authorized for an amount lower than the total order value when the order is initially submitted. This authorization will be voided once your order is processed for shipment in our warehouse, at which point your card will be charged for the full amount. If you choose to cancel an order with an authorized payment status, our Billing Department will void the authorization, typically within 5-7 business days.

Race Protocol offers the option to store payment information in your account page on the website. Stored payment data will remain active until the expiration date or until the authorization expires.

Certain manufacturers may impose selling restrictions on products listed on Race Protocol. If you order a product that cannot be shipped to your location, a Race Protocol representative will contact you with further details.

 

Warranty

Any warranties on products sold by Race Protocol are those provided by the manufacturer. The customer understands that all warranties are void if any product defect is caused in whole or in part by negligence, improper installation, lack of proper maintenance, abuse, misuse, accidents, or exposure to extreme conditions like water or fire. The customer also acknowledges that there is no warranty, express or implied, on any parts used for purposes for which they were not originally intended.

The customer understands that there is no warranty on electrical parts or parts used in a racetrack environment. The customer agrees to notify Race Protocol immediately upon discovering any product defect. Defective items must be returned for replacement according to Race Protocol’s return policy and at the customer’s expense. Race Protocol will replace any defective items that meet the return or replacement requirements.

Race Protocol will not be liable for any special, incidental, or consequential damages, or for loss, inconvenience, damage, or expenses arising directly or indirectly from the use (or inability to use) of any product or its components, whether used alone or in combination with other equipment, or for commercial loss of any kind, regardless of whether Race Protocol was advised of the possibility of such damages.

Race Protocol makes no representation that the installation or use of parts purchased will not affect any existing warranty on the customer’s vehicle. The customer understands and assumes all liability and risk associated with the use of products sold by Race Protocol.

 

Lost Packages

If you do not receive your package and the tracking information indicates it has been delivered, you must contact us within five days of the delivery date. This will allow us to initiate a lost package inquiry with the shipping carrier you selected. We will not send a replacement until the carrier completes their investigation and authorizes the shipment of a new item. UPS typically takes up to eight business days from the claim initiation, USPS may require between five and ninety business days depending on your country’s policies, and FedEx can take between twenty-one and twenty-eight business days to resolve the issue. Please note that these timeframes are set by the carrier, not Race Protocol, and we cannot guarantee that the carrier will approve any reimbursement or replacement until the claim is fully processed.

Race Protocol does not offer refunds for lost packages under any circumstances.

Items purchased during clearance sales or “limited-time promotions” are not eligible for a replacement item if damaged. These items are sold as-is, without warranty, and cannot be exchanged. If a clearance or limited-quantity sale item is damaged in shipping, we will only issue a refund based on the purchase price, not a replacement.

Shipping fees are non-refundable.
